Virginia Von Schaefer, M.D., Inc., as well as its affiliates and subsidiaries (“VVS MD”) respects your privacy. Accordingly, it has adopted the following privacy policy. This policy notifies you of:

  • what personally identifiable information of yours is collected from you through VVS MD’s website,

  • with whom the information may be shared,

INFORMATION ON COLLECTION AND USE

VVS MD collects personally identifiable information when you request information from VVS MD. On such occasions, VVS MD may ask for your name, email address, zip code and personal information concerning your interests, occupation, gender and other demographic information. VVS MD also receives and records information from server logs from your browser including cookie information relating to pages requested.

VVS MD does not seek to collect such information from persons under the age of 18. If you are under the age of 18, please do not submit any such information to us. If you are the parent or guardian of a person under the age of 18 who has provided such information to us, please inform us (through the VVS MD website or telephone number listed above) and we will remove such information from our database as described further below.

In addition, no person (of any age) is required to provide us with the personally identifiable information we request. If you do not wish to provide such information, you are free not to do so. Your provision of requested information to us through VVS MD’s website or other means is presumed by us to be voluntary and with your consent to the uses described herein. If after submitting personally identifiable information to us, you wish to “opt-out,” please contact us as noted above and we will remove your information from our database as set forth below in the section titled “Managing Your Information.” Please know that such a decision will not stop advertising or content that is generated prior to the time when we can accomplish the removal of your information.

VVS MD uses the information you provide to us to customize advertising and content that we present to you. VVS MD will not sell or rent your personally identifiable information to any third party except when:

  • You have been given an opportunity to “opt out” of sharing the information and have declined to exercise that right within the time period provided;
  • VVS MD must share the information in order to provide a product or service that you have requested, in which case we will demand that any third party we use to fulfill your order agree that it does not have the right to use the personally identifiable information other than to fulfill your request; or 
  • VVS MD is required to respond to subpoena, court orders or other legal process requiring such disclosure.

USE OF COOKIES

In addition, for certain categories of personal information, you have the right to request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties.

Right to delete your personal information

You may request to delete your account and the personal information we have collected from you or maintain about you.

Right to opt-out from the sale of your personal information

You may request, at any time, to direct us to stop “selling” (for the purposes of the CPRA) your personal information. We do not sell the personal information of consumers we actually know are less than 16 years of age.

You have the right to not receive discriminatory treatment for the exercise of the privacy rights conferred by the CPRA. We may offer you certain financial incentives permitted by applicable law as compensation for allowing us to collect, sell, or maintain your personal information.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. If we cannot verify the requestor’s identity or authority, we will inform the requestor that their identity cannot be verified. 

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

You may also submit such requests through an authorized agent. To designate an authorized agent, please send us a notarized power of attorney / notarized letter authorizing said agent. Requests from agents that do not submit such proof that they have been authorized by you to act on their behalf will be denied.

We will notify you whether we have complied with your request to delete or correct.

We will maintain records of consumer requests made pursuant to CPRA for 24 months. The information retained for record-keeping purposes will not be used for any other purpose except as reasonably necessary for the business to review and modify its processes for compliance with the CPRA, and will not be shared with any third party except as necessary to comply with a legal obligation.

We will keep your data as long as it is reasonably necessary for the purposes described in this privacy policy. You may choose not to receive unsolicited marketing material from VVS MD and you have the right to request deletion of your VVS MD account information, subject to VVS MD’s need to keep appropriate archives of its business operations.

SECURITY

VVS MD employs reasonable measures to maintain all personally identifiable information provided by you on computer servers in a controlled and secured environment in an effort to hinder unauthorized access, loss, alteration, use or disclosure of such information. VVS MD utilizes secure socket layer encryption technology and firewall network protection to protect personally identifiable information that is transmitted to VVS MD’s websites. Unfortunately, the nature of the Internet is such that information may be transmitted over networks without appropriate security measures and may be accessed, deleted, altered, used, or disclosed by unauthorized persons.

Personal data may be transferred to countries which do not have laws or regulations which protect personal data, such as the United States, where the server for VVS MD’s website is located.
